Artists Ordered to Pay Up to $9 Million Over BAYC Dispute: Yuga Labs Wins Big

After their counterclaims in a well-known copyright litigation were dismissed, artists Ryder Ripps and Jeremy Cahen were ordered by the court to pay roughly $9 million in damages to Yuga Labs, the company behind the Bored Ape Yacht Club (BAYC).

Since May 2022, Ripps and Cahen—who are credited with starting the Ryder Ripps BAYC (RR/BAYC) collection—have been involved in court disputes. Their initiative, which capitalized on the BAYC brand, was determined to violate Yuga Labs' copyrights. This resulted in a lawsuit, which Yuga Labs won in April 2023.

At first, the court ordered Ripps and Cahen to pay Yuga Labs $1.57 million in damages as well as to pay for legal fees. On the other hand, an increased fine of over $9 million was disclosed in a recent court document dated February 2. This amount, which reflects the seriousness of the copyright violation, comprises disgorgement, legal expenses, and expert witness fees.

In addition, any RR/BAYC NFTs that the artists possess must be destroyed or turned over to Yuga Labs for destruction. This directive applies to all associated, infringing works, such as ads and promotional goods that use the BAYC mark. They must also give up the smart contract linked to the RR/BAYC collection, as well as any social media profiles.

The judge rejected the counterclaims that Ripps and Cahen had brought, which contained claims of emotional distress and a request for a declaratory declaration that no defamation had occurred. The court's ruling highlighted Yuga Labs' allegations of cybersquatting and fraudulent designation of origin, establishing a precedent for the defense of intellectual property rights in the quickly developing NFT field.

Cahen, who goes as Pauly among his X fans, has stated that he intends to challenge the ruling in the California Ninth Circuit Court, suggesting that this legal drama may go on.
